Local government

The specificity of legal services for public entities, including local government units, stems from the wide range of competences and the range of tasks they perform. Local government bodies are not only responsible for carrying out their own tasks and tasks delegated to them by the government, but also carry out infrastructure or construction investments either on their own or with external funding. Local government bodies also have the power to enact local laws, which requires particular care due to the extensive supervisory system.

The legal service of the JST [Local Government Bodies] therefore requires knowledge not only of the law and administrative procedure, but also an understanding that public law and private law intersect here. On the one hand, local government bodies have the right to sovereignly shape the legal situation of a citizen, on the other hand, they appear in civil law transactions on equal terms with other market participants.

Hence, the legal service of local government includes in particular:

• legal services to the legislative and executive bodies, including through participation in the work of councils and committees;
• legal services to municipal and district organisational units and municipal companies;
• supporting the drafting of local legislation;
• providing opinions on complex legal issues relating to the conduct of administrative proceedings;
• supporting local government units as contracting authorities in the public procurement procedure and during the performance of contracts;
• representing before administrative and common courts.
